# Shuaa Renderer - Pre-Release Licence Agreement (Beta) **Effective 10 October 2026** *Document revision: 10 October 2026. Legal documents are identified by date, not by Shuaa version number.* This Agreement is between you ("you") and Hassen Guennari ("we", "us"), the author of Shuaa Renderer. It covers the Pre-Release builds of Shuaa Renderer, including the Beta, with their documentation and sample files (the "Software"). Shuaa Renderer is published under the name RenderWay; until a RenderWay company exists, the party to this Agreement is Hassen Guennari. By downloading, installing or using the Software you accept this Agreement. If you do not accept it, do not download, install or use the Software. --- ## 1. What the Beta is - The Software is a **Pre-Release**: unfinished, still missing features, and distributed free so that people can use it and report problems. - It may crash, freeze Cinema 4D, produce wrong images, behave in unexpected ways, and **corrupt or lose scenes, files and renders.** Keep backups of everything you open while the Software is installed. - It drives your graphics card at full load, often for long periods. Make sure your computer is adequately cooled and powered. - **You may use it for any work, commercial work included, but always entirely at your own risk** (Sections 3, 10 and 11). --- ## 2. Definitions - **Commercial Use** - work for which you or anyone else is paid: client work, work for an employer, freelance work, and any output sold, licensed or used to earn money. --- ## 3. Your licence We grant you a free, personal, non-exclusive, non-transferable licence to install and use the Software on computers you own or control, until the build stops (Section 4) or this Agreement ends. **Commercial Use is allowed, as a freelancer or in a studio, entirely at your own risk.** A Pre-Release can fail at any moment, including in the middle of paid work. Before relying on it for a job, test it on that job and keep backups. Sections 10 and 11 apply in full to Commercial Use: we give no warranty, we are not liable for any loss, and nothing is refunded or compensated. Paid licences may be offered later under a separate agreement. --- ## 4. The end date, the watermark, and new builds - **This Beta may be used until 31 January 2027, and during 3 days of grace until 3 February 2027; using it after that, including by changing the computer's clock, breaches this licence.** Each Pre-Release build has an end date set in that build; for the Beta 0.9.1 it is 31 January 2027. The date is shown in the Software and on the download page. A newer build may carry a later date. - From 24 January 2027 the Software reminds you of the date. After 31 January it keeps rendering for 3 days of grace, until 3 February 2027, then it tells you so and renders nothing more. The end date never modifies, locks or deletes your scenes; they keep opening in Cinema 4D. - **To apply that date, the Software reads today's date from https://renderway.com** when Cinema 4D starts, and again when you render if its last answer is more than an hour old (the Privacy Policy describes it). When it cannot reach the website, it uses your computer's clock and the latest date it has already seen; if the clock reads more than 2 days earlier than that date, it renders nothing until the clock is corrected or the website can be reached. - To continue, download a newer build. We are not obliged to publish one. - **Images rendered to the Picture Viewer with a Pre-Release build, and images saved or sent to it from the Live Viewer, carry a small Shuaa Renderer mark.** - Your renders are yours to use, publish or sell (Section 7). A credit such as "Rendered with Shuaa Renderer" is welcome but not required. --- ## 5. Restrictions You may not: - reverse engineer, decompile or disassemble the Software, except where the law gives you that right and it cannot be excluded; - modify the Software, or circumvent, disable or tamper with its end date, its watermark or any other protection - including by changing your computer's date or time to keep using a build after its end date; - redistribute the Software or its download files, rent, lease, sell or sublicense it, or offer it as a hosted or network service (to share Shuaa Renderer, share the link to https://renderway.com/shuaa/download instead); - remove or alter any copyright, trademark or other notice in the Software; - use or export the Software in breach of the export-control or sanctions laws that apply to you or to us. --- ## 6. Problem reports and feedback - When you choose to, the Software saves a problem report on your computer as a zip file, and uploads it to us only when you press Send Report. The Privacy Policy describes what it contains and where it goes. Nothing is sent to us unless you send it. - Ideas, suggestions and other feedback you give us may be used by us freely, to improve the Software or for any other purpose, without payment or any obligation to you. This does not apply to your scenes, assets or renders, which stay yours (Section 7). --- ## 7. Ownership - The Software is licensed, not sold. We keep all rights in it, including all intellectual property. - **Your work is yours.** We claim no rights in the images, animations, scenes or other output you produce with the Software. - You are responsible for having the rights to the scenes, models, textures and other assets you use with the Software. - Sample scenes and assets we distribute may be used in your own projects, but may not be redistributed on their own or as part of an asset pack. --- ## 8. Third-party software The Software includes third-party components under their own licences. They are listed, with their notices, in `THIRD-PARTY-NOTICES.md`, included in the download. Those licences govern those components. **NVIDIA components.** The Software includes software from NVIDIA Corporation (the CUDA runtime and code built from the OptiX SDK - the OptiX engine itself comes with your NVIDIA driver), licensed to us by NVIDIA. For those components: - they are licensed, not sold, and may be used only as part of the Software, only on NVIDIA graphics hardware the Software supports; - you may not copy, extract, modify, reverse engineer, decompile or disassemble them, use them separately from the Software, or distribute them, except where the law gives you that right and it cannot be excluded; - NVIDIA and its licensors keep all rights, title and intellectual property in them, and you must keep confidential any part of them that is not public; - NVIDIA gives you no warranty and no support for them and, to the maximum extent the law allows, is not liable to you for any loss or damage arising from them; - NVIDIA is a third-party beneficiary of these terms and may enforce them. --- ## 9. Support and updates We are not obliged to provide support, fixes, updates, new builds or any feature, on any timetable. We may change, pause or end the Pre-Release programme at any time. What is new and fixed in each build, and answers to frequent questions, are published at https://renderway.com/shuaa/support. --- ## 10. No warranty The Software is provided **"as is" and "as available", without warranty of any kind**, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy of results, non-infringement, or that it will run without errors or interruption or without harming your data. This applies to Commercial Use in full. **Nothing in this section limits statutory rights that cannot be excluded by agreement.** --- ## 11. Limitation of liability To the maximum extent permitted by law: - **Neither we nor anyone working with us is liable for any loss or damage of any kind** arising from your use of, or inability to use, the Software, for Commercial Use or not - including lost, corrupted or damaged scenes, files or renders; lost work or time; missed deadlines; lost profits, revenue, clients or business; claims from your clients or employer; damage to or failure of hardware; and any indirect, incidental, special or consequential damage - even if we were told that such loss was possible. - **The Software is free, and no refund, credit, compensation or damages of any kind are owed**, for any reason. - Where the law does not allow that exclusion, our total liability for all claims together is limited to fifty US dollars (USD 50). Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. **If you are a consumer in the EU or UK, your statutory rights are unaffected by this Agreement.** --- ## 12. Term and termination - This Agreement applies from installation until the build stops (Section 4) or the Agreement ends. - It ends automatically if you breach Section 3 or Section 5. - When it ends, stop using the Software and uninstall it. Sections 6, 7, 8, 10, 11 and 13 survive. --- ## 13. General - **Governing law.** This Agreement is governed by the laws of Tunisia. If you are a consumer resident in the EU or UK, you keep the mandatory protections of your country of residence and may bring proceedings in your local courts. - **Assignment.** You may not assign this Agreement. We may assign it to a successor, including a RenderWay company once it is incorporated. - **Severability.** If any provision is held unenforceable, it is applied to the extent the law allows and the rest stays in effect. - **Entire agreement.** This Agreement is the entire agreement between us about the Pre-Release. How we handle data is described in the Privacy Policy (`PRIVACY.md`, included in the download and published at https://renderway.com/shuaa/legal/privacy). `LICENSE.txt` in the download is a short summary of this Agreement; where they differ, this Agreement governs. - **Changes.** A newer build may come with a revised Agreement; installing or using that build means accepting it. A revision never applies to a build you already have. - **Language.** This English text governs; any translation is for information only. --- **Contact:** shuaa-renderer@renderway.com - https://renderway.com/shuaa
